1. What is ibizAI

ibizAI is an AI-powered information and concierge service for Ibiza, accessible via WhatsApp. It is operated by ibizAI and its partners. By using the service, you agree to these terms.

2. Nature of the Service — Referral Only

ibizAI is a referral and information platform only. It connects users with independent local operators in Ibiza across transport, wellness, nightlife, food, and leisure categories. ibizAI does not provide, perform, supervise, or control any of these services.

ibizAI acts solely as an introducer. The moment a user is connected to an operator, ibizAI's role ends. All subsequent interaction, service delivery, and any resulting relationship is exclusively between the user and the operator.

Information and recommendations provided by ibizAI are based on curated local knowledge and do not constitute professional, medical, legal, or safety advice of any kind.

3. Third-Party Operators — No Liability

All operators referenced by ibizAI are independent third parties. ibizAI is not a party to any contract, transaction, or agreement between the user and any operator. ibizAI does not employ, supervise, or act as agent for any operator.

ibizAI accepts no responsibility or liability whatsoever for: the quality or outcome of any service delivered by an operator; any injury, illness, allergic reaction, adverse effect, or harm resulting from a wellness, beauty, health, or physical treatment; any loss, theft, damage, accident, or incident occurring during or in connection with a third-party service; failure of an operator to honour a booking, quote, or agreement; and any dispute between a user and an operator.

Users engage with operators entirely at their own risk. ibizAI strongly recommends verifying qualifications, confirming service details, and using personal judgment before proceeding with any booking.

4. Payments & Transactions

ibizAI does not handle, process, or hold any payments. All financial transactions are made directly between the user and the operator. ibizAI is not responsible for pricing accuracy, refunds, cancellations, or any financial dispute arising from a third-party service.

ibizAI may receive a referral commission from operators for introductions made through the platform. This does not affect the independence of recommendations or create any liability toward the user.

5. Wellness & Health Services

ibizAI may connect users with independent wellness, beauty, skincare, massage, or health practitioners. These services are performed solely by the operator and are entirely outside ibizAI's control. ibizAI does not verify professional certifications, product ingredients, hygiene standards, or treatment suitability for individual users.

Users with medical conditions, allergies, or specific health concerns should consult a qualified professional before booking any treatment. ibizAI accepts no liability for any adverse outcome resulting from a wellness or health service.

6. Data & Privacy

ibizAI interacts with users via WhatsApp. We do not store personally identifiable information. Your WhatsApp number is anonymised and used only to maintain conversation context and improve the service. We do not sell, share, or use your data for advertising.

By messaging ibizAI, you consent to this minimal data usage for the purpose of delivering the service.

7. Limitation of Liability

To the fullest extent permitted by applicable law, ibizAI and its operators, partners, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of the service or reliance on any recommendation or referral made through it.

ibizAI is provided as-is. We make no warranty that the service will be uninterrupted, error-free, or that any specific result will be achieved.

8. Acceptable Use

You agree not to use ibizAI for unlawful purposes, to harass or abuse the service, or to attempt to extract, scrape, or reverse-engineer the system. ibizAI reserves the right to block users who abuse the service without prior notice.

9. Changes to These Terms

We may update these terms from time to time. The current version is always available at ibizai.love/terms. Continued use of the service after changes constitutes acceptance of the updated terms.
